Family law: My ex-husband pays me a contribution. What happens if he dies?

Your ex-husband pays you a maintenance fee. It is legitimate to wonder what will happen if he dies. 

Maintenance is an individual debt, which disappears at the debtor’s passing. The amount will therefore no longer be paid after the debtor’s death.

However, the debtor may have made provision for special measures, which must be mentioned in the will to be valid.

The current spouse and/or the heirs of the debtor therefore owe nothing to the former spouse. They will only have to repay the alimony debts accumulated before the debtor’s death.
